3. Services Offered

Surf & Swirl provides ice cream van hire services for various events, including but not limited to birthdays, weddings, community events, and corporate functions. Specific offerings may include soft serve ice cream, gelato, milkshakes, hot dogs, and hot jam donuts.

4. Booking and Payment

4.1 Booking Confirmation

All bookings must be confirmed in writing through our website or via email. A non-refundable deposit may be required to secure your booking.

4.2 Payment Terms

Full payment is due before the event unless otherwise agreed. We accept various payment methods, including credit cards and bank transfers.

5. Cancellation and Refund Policy

5.1 Cancellation

If you need to cancel your booking, you must notify us in writing. Cancellation fees will apply according to the following terms:

  • More than 28 days before the event: Full refund of any deposits paid.
  • 7 to 28 days before the event: 50% of the deposit refunded.
  • Less than 7 days before the event: No refund.

5.2 Change of Date

If you wish to change the date of your event, we will make every effort to accommodate your request, subject to availability.

6. Responsibilities of the Client

The client agrees to:

  • Ensure that the event location is safe and accessible for our staff and equipment.
  • Obtain any necessary permits or permissions required for our ice cream van to operate at the event site.
  • Inform us of any specific requirements regarding dietary restrictions or allergies.

7. Limitation of Liability

Surf & Swirl is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the total fees paid to us for the services in question.

8. Indemnification

You agree to indemnify and hold harmless Surf & Swirl and its employees from any claims, damages, losses, liabilities, or costs arising from your breach of these Terms or your use of our services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Gold Coast, Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Gold Coast, Queensland.
